Enforcement of the Town Code in Highland Beach is the duty of the code enforcement officer. If violations of the code or any ordinances are found, the code inspector notifies the violator by issuing a citation, and gives the violator a reasonable period of time to correct the violation.
Should the violation continue beyond a reasonable period of time, the code enforcement officer may then file a Statement of Violation and Request for Hearing with the Code Enforcement Board. Before scheduling a hearing, the Special Magistrate has the authority to order the violator to pay a fine each day until such time as the violation is corrected.
If a formal hearing of a case is scheduled, the Code Enforcement Board has the authority to subpoena alleged violators, witnesses and evidence to appear before him/her. Cases are presented by the Town attorney or a member of the administrative staff, testimony is taken under oath, and at the conclusion of the hearing, the Code Enforcement Board has the authority to issue orders commanding whatever steps are necessary to bring a violation into compliance. Appeals of a final administrative order of the Code Enforcement Board may be filed to the circuit court.
